By accessing or using the services provided by Lokesh Motwani operating as Web Fortuners ("Service Provider," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access our services.

As a client, you agree to:
Each project will be governed by a specific Statement of Work (SOW) or contract that outlines deliverables, timelines, and costs. The SOW supplements these Terms.
Any changes to the project scope must be agreed upon in writing. Additional work may result in adjusted timelines and costs.
Certain project milestones may require client approval. Delays in approval may impact project timelines and are not the responsibility of the Service Provider.
Service fees are outlined in the project agreement. All fees are in USD unless otherwise specified.
Late payments may incur a 1.5% monthly interest charge. We reserve the right to suspend services for overdue accounts exceeding 30 days.
Refunds are evaluated on a case-by-case basis. Work already completed is non-refundable.
You retain ownership of materials you provide. You grant us a license to use these materials solely for providing our services.
Upon full payment, you own the custom work product created specifically for your project. We retain rights to general methodologies, techniques, and non-custom code.
We retain ownership of pre-existing intellectual property, including frameworks, libraries, and tools developed before or outside your project.
We reserve the right to showcase completed work in our portfolio unless you request confidentiality in writing.
Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of services.
We warrant that services will be performed in a professional manner consistent with industry standards. We will remedy any non-conforming services at no additional charge.
EXCEPT AS EXPRESSLY PROVIDED, SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
We are not responsible for third-party services, APIs, or platforms used in your project. You are responsible for separate agreements with third-party providers.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
You agree to indemnify and hold harmless Lokesh Motwani and Web Fortuners from any claims arising from:
Either party may terminate services with 30 days written notice. Payment for work completed remains due.
We may terminate immediately for breach of Terms, non-payment, or illegal activities.
Upon termination, we will deliver completed work upon receipt of payment. Confidentiality obligations survive termination.
Neither party is liable for delays or failures due to circumstances beyond reasonable control, including acts of God, natural disasters, war, terrorism, pandemic, or internet outages.
These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration in Udaipur, Rajasthan, India.
These Terms, along with project-specific agreements, constitute the entire agreement between parties.
We may update these Terms. Continued use of services after changes constitutes acceptance.
If any provision is found unenforceable, the remaining provisions continue in effect.
Failure to enforce any right does not constitute a waiver of that right.
